Module Description: The student will understand the duties and obligations imposed upon the master of a ship with respect to legislative and commercial law which governs the day to day management of a modern merchant vessel. this module includes the relvant material required by the STCW Code, Table II/2
 
Learning Outcomes
On successful completion of this module the learner will be able to:

LO1 Assess the role of International, European Union and Domestic legislation which impacts upon the daily management of a ship
LO2 Analyse the legal requirements both nationally and internationally for ship registration, and certifcation.
LO3 Appraise legislation in respect to health and safety legislation as it impacts on personnel both internal and external to the ship.
LO4 Examine the law of pilotage, pollution, wreck and salvage from both the statutory and contractual perspectives.
LO5 Analyse the legal and industrial relationship between the shipowner as employer and the ship's master as his representative.

Indicative Content
Maritime Legislative Law
The role of UNCLOS, the IMO, the ILO and the pertinent conventions which impact on merchant ship operations.
Commercial Contracts and Torts
The legal significance of ship registration and the procedure to obtain same. The various inspections and consequent certifcation required before a ship can proceed to sea. The procedures for the attachment of liens on cargo and ship.
Health and Safety
the M.S. (Load Line) Rules 1968 and their significance. The Navigational Warnings Regulations contained in the SOLAS Convention. The law relating to distress at sea. The legislation with regard to safe access to ships. The law relating to the carriage of dangerous goods and the relevence of the IMDG Code.
Wreck and Salvage
The law of pilotage, the pilotage contract and legal aspects of the master/pilot relationship. MARPOL and the master's criminal and civil liabilities in the event of polltion. The role of the Receiver of Wreck. The Salvage Convention and the master's and salvors rights and responsibilities in a modern salvage contract.
Master & Crew
The Merchant Shipping Acts and current employment legislation in respect of the shipowner, the master and the seaman. The law relating to the engagement and discharge of the crew. The law in relation to discipline aboard ship.
