This module is designed to examine the legal framework within which the recreation and leisure sector operates in Ireland and to introduce specific areas of law encountered by the sporting community and recreation and leisure professionals.

LO1 |
Describe the administration of justice in Ireland with reference to civil and criminal procedure and the relevance of both to the recreation and leisure sector |
LO2 |
Identify the principal sources of Irish law, evaluating the impact of such regulation on recreation and leisure activities |
LO3 |
Recognise and observe relevant legislation and legal principles pertaining to: contract, insurance, equality, negligence, trespass against the person, defamation, health and safety at work |
LO4 |
Outline core features of employment/ labour law and identify key statutory protections provided in Irish law |
LO5 |
Locate, appraise and analyse primary and secondary legal material - both domestic and European - of relevance to the recreation and leisure industries and thus be able to pursue further legal studies. |

Indicative Content |
Nature and function of law
Divisions of law; substantive and procedural law; criminal and civil processes with recent/current examples pertinent to the recreation and leisure industry/sector such as sponsorship agreements and litigation cases.

Administration of justice
The Courts system: structure, jurisdiction and administration; legal personnel: barristers, solicitors and the judiciary; juries; access to the courts and legal aid; alternative dispute resolution and arbitration.

Sources of law
The Constitution: institutions of the State, fundamental rights; Legislation - enactment and statutory interpretation; precedent/case law and judicial reasoning; European Community law and the European Union - the institutions, decisions/directives/regulations and implementation in Ireland.

Contract law
Formation; terms; capacity; mistake and misrepresentation; consumer protection; duress and undue influence; public policy considerations; discharge; remedies. Emphasis placed on examples from the sporting sector

Insurance law
Types of insurance contract; formation; principles of insurance - uberrimae fidei, insurable interest, indemnity, subrogation, contribution.
|
Tort
Negligence; professional negligence and vicarious liability; trespass against the person - elements of the torts and defences; defamation; nuisance; occupiers liability.

Employment law
Contracts of employment; equality in employment and in provision of services; legislation of minimum wage, working time, parental and other leave; safety legislation and enforcement; dismissal.
